Is a house alarm system a fixture that transfers with the property or can the seller take the alarm when they move out?
The answer to this question is found in Paragraph 17 of the CCRA contract. The contract says “the sale includes all fixtures, equipment and improvements of any kind which now exists and are attached to . . . the premises such as . . . seller-owned security systems.”
Security systems are either owned or leased from the monitoring company. If the system is seller owned, the system must stay with the house. If the system is leased only the leasing/monitoring company may remove the system and not the seller.
Please note that whether the system is leased or seller-owned should be disclosed on the Seller Disclosure Statement.
Today’s historical note: Elmwood Avenue was previously known as Upper Street as it was the upper boundary of the city. As the city grew, the street was renamed Elmwood Avenue for the Elm tree that was abundant in the area.
